Public Prosecutor Lin Chun-liang of this Office has concluded the investigation regarding the suspect, Mr. Liu, for his alleged violations of the Child and Youth Sexual Exploitation Prevention Act, Offenses Against Privacy, and related charges, and has officially filed a public prosecution with the Taiwan Chiayi District Court. Summary of the case is as follows:

I. Investigation Process

The defendant, Liu, is the person-in-charge of the Minxiong Music Store, located at No. 63, Baosheng St., Zhongle Village, Minxiong Township, Chiayi County. Upon noticing suspicious activity in the music store's restroom, a victim reported the matter to the police. The Minxiong Precinct of the Chiayi County Police Bureau subsequently reported the case to Prosecutor Lin for direction, and a search warrant was applied for and granted by the Taiwan Chiayi District Court.

On February 26, 2026, at approximately 19:00, the task force executed the search warrant at the aforementioned music store. The seizure included:

• 2 pinhole cameras

• 3 hard drives

• 8 mobile phones (including Nokia, iPhone, Samsung Galaxy, ASUS, and OPPO models)

• 1 tablet computer

• 2 desktop computer towers

• 1 computer monitor

• 1 laptop

• Other electronic equipment and related items.

II. Summary of Criminal Facts

With criminal intent to record sexual images of children and youth, illegally capture sexual images of others without cause, and commit offenses against privacy, Liu installed pinhole cameras and activated the recording function in the store’s restroom from July 16, 2025, to February 25, 2026. He illicitly recorded the private body parts and sexual images of individuals using the restroom, comprising 6 adults and 10 minors, severely infringing upon their right to privacy.

III. Statutory Violations and Prosecution Opinions

1. Offenses Against Adult Victims (Nos. 1 to 6 in the Indictment Appendix): The defendant is charged under Article 315-1, Item 2 of the Criminal Code (secretly recording non-public activities of others without cause) and Article 319-1, Paragraph 1 of the same Act (secretly recording sexual images of others by video without consent and without cause).

2. Offenses Against Minor Victims (Nos. 7 to 16 in the Indictment Appendix): The defendant is charged under Article 315-1, Item 2 and Article 319-1, Paragraph 1 of the Criminal Code, as well as Article 36, Paragraph 1 of the Child and Youth Sexual Exploitation Prevention Act (recording sexual images of youth).

3. Application of Rules on Joinder and Sentencing:

   • Continued Offenses & Imaginary Conjunction of Offenses: The illicit recordings were conducted continuously within close temporal proximity at the same location, constituting a single continuous offense. As a single act infringed upon multiple statutory titles, pursuant to Article 55 of the Criminal Code, it constitutes an imaginary conjunction of offenses (imaginaler Idealkonkurrenz).

     • For adult victims, the prosecution requests sentencing under the gravest offense: illegally capturing sexual images of others without cause.

     • For minor victims, the prosecution requests sentencing under the gravest offense: Article 36, Paragraph 1 of the Child and Youth Sexual Exploitation Prevention Act.

   • Separate Punishment for Multiple Crimes: The 16 crimes committed against the 16 victims arose from distinct intents and separate acts; thus, separate trials and cumulative punishments are requested.

   • Confiscation: The seized pinhole cameras, hard drives, mobile phones, computers, and related digital files constitute tools used in the commission of the crime or media attached thereto, and their confiscation is requested in accordance with the law.
