Chiayi District Prosecutors Office Indicts Dabu Township Mayor Wu and Others for Violations of the Anti-Corruption Act

I. Case Background Prosecutor Chiu Yi-lin of this Office investigated allegations of corruption involving the Mayor of Dabu Township, Chiayi County (identified as Wu), other public officials, and private contractors. Under the direction of the Prosecutor, a task force was formed with the Southern Regional Sector of the Agency Against Corruption (AAC), Ministry of Justice. Following meticulous evidence gathering, search warrants issued by the Chiayi District Court were executed on October 22, 2025 (Year 114). Searches were conducted at 20 locations, including the residences and offices of nine defendants. After interrogation, Mayor Wu and a contractor (identified as Zhang) were detained and held incommunicado by court order. The investigation concluded on February 8, 2026 (Year 115), and a formal public prosecution has been initiated.
II. Summary of Investigation and Charges The investigation revealed that from 2020 (Year 109) until the searches in 2025, the defendants engaged in illicit gains (profiteering) and the solicitation of bribes in connection with various engineering projects outsourced by the Township Office. The charges are as follows:

Defendant Wu (Mayor):

Profiteering: Along with his younger brother (Defendant Wu, Chairman of a Community Development Association), he is charged with "Profiteering via Supervised Affairs" under Article 6, Paragraph 1, Subparagraph 4 of the Anti-Corruption Act. The brother has returned the illicit gains totaling NT$226,299.

Solicitation of Bribes: In the "Dabu Blue Highway Recreation Belt Project" tender, the Mayor and the Head of the Agricultural and Tourism Section (Defendant Hou) allegedly solicited a bribe of NT$1 million under the guise of "souvenir funding," violating Article 5, Paragraph 1, Subparagraph 3 of the Anti-Corruption Act. Defendant Zhang (the contractor) utilized this opportunity to commit fraud, illegally obtaining NT$1 million (Article 339, Paragraph 1 of the Criminal Code).

Breach of Trust: Regarding the private use of an official vehicle, the Mayor is charged with "Breach of Trust by a Public Servant taking advantage of their office" (Articles 134 and 342 of the Criminal Code) for causing the Township Office to pay NT$4,967 in non-official fuel expenses.

In the township office demolition and reconstruction tender, he allegedly attempted to defraud NT$6 million, successfully obtaining NT$2.7 million.

Multiple contractors are charged with "Lending/Borrowing of Licenses for Bidding" under the Government Procurement Act and "False Entry of Accounting Vouchers" under the Business Accounting Act.

III. Sentencing Recommendations and Detention Status As a two-term local chief executive, Defendant Wu was expected to administer by the law. Instead, his involvement in profiteering and bribery has depleted public funds and caused profound social harm. Defendant Zhang, as a contractor, seized opportunities to commit crimes. Upon the transfer of the case to the Court, the Prosecution recommends continued detention and incommunicado status for both, as alternative measures (such as bail or electronic monitoring) are insufficient to prevent flight or collusion.
