The Chiayi District Prosecutor's Office actively supervised the court's ruling and won the lawsuit to invalidate the election results of two cases

Mr. Cai Jian-Wang, the elected village chief of Wantan Village, Zhongpu Township, Chiayi County, was declared invalid in the 22nd term of the local election by the Chiayi District Court on March 15, 2023. This case was cooperatively investigated by Prosecutor Ke Wen-Ling, the Criminal Investigation Corps of the Chiayi County Police Bureau, the Zhongpu Precinct, and the Investigation Bureau, Chiayi County Investigation Station under the Ministry of Justice Investigation Bureau. On September 6, 2022, reconnaissance behavior was carried out. It was deemed that Village Chief Cai violated Article 97, Paragraph 1 of the Public Officials Election and Recall Act. Public prosecution was initiated on September 13, 2022, and a lawsuit to invalidate the election was filed in December 2022. In the criminal aspect, the Chiayi District Court rendered a guilty verdict on December 30, 2022. In the civil aspect, the Chiayi District Court, in its first-instance judgment on March 15, 2023, declared the election invalid.

Mr. Huang Shi-Jun, the elected village chief of Daxi Village, 11th district, West District, Chiayi City, was declared invalid in the 11th term of the local election by the Chiayi District Court on March 29, 2023. This case was cooperatively investigated by Prosecutor Wu Hsin-Lan, the Investigation Bureau, Chiayi City Investigation Station under the Ministry of Justice Investigation Bureau the Criminal Investigation Corps of the Chiayi City Police Bureau, the First Precinct, and the Second Precinct. It was determined that Mr. Huang, the village chief with the surname Huang, violated Article 99, Paragraph 1 of the Public Officials Election and Recall Act. Public prosecution was initiated on November 23, 2022, and a lawsuit to invalidate the election was filed in December 2022. In the civil aspect, the Chiayi District Court, in its first-instance judgment on March 29, 2023, declared the election invalid.

This office does not tolerate any illegal actions committed by candidates, their campaign staff, relatives, and friends. In addition to initiating criminal prosecutions against corrupt candidates, civil lawsuits to invalidate their election are also filed. The core objective is to ensure fair elections through election investigation. The prosecutors of our office actively supervise the court's rulings and, considering the defendants' conduct in bribery cases, cases that are clearly unsuitable for probation are appealed. So far, 8 cases have been appealed, with the hope that appropriate court judgments will deter undemocratic and unlawful behavior.
